The government has referred the question of revising or clarifying net neutrality norms to the Telecom Regulatory Authority of India (TRAI), asking it to recommend what changes need to be made.

The trigger is 5G network slicing: a technology that allows a single physical 5G network to be divided into multiple virtual networks, each with different performance characteristics. A slice optimized for low-latency healthcare applications works differently from one optimized for high-bandwidth video streaming. 

The technical argument is that current net neutrality rules, written in 2018, don't account for this capability and create ambiguity about whether slicing is even permitted.

India's net neutrality framework — one of the stronger such frameworks in the world when it was adopted — holds that all internet traffic must be treated equally, without throttling, blocking, or preferential treatment of any content or service. The 5G slicing question is whether that principle needs to be reinterpreted, or whether carved-out exceptions need to be created for specific use cases.

What net neutrality actually protects — and what loosening it risks

Net neutrality is one of those concepts that sounds abstract until the absence of it becomes concrete. The principle is straightforward: your internet service provider treats all traffic the same, regardless of where it comes from or what it is. Your connection to an independent news site loads at the same speed as your connection to a site that pays your ISP for preferential treatment. A new streaming service competes on the same technical footing as an established one. A small business's website isn't disadvantaged because it can't afford a fast lane.

We've written before about what net neutrality is and why it matters for internet freedom — and the short version is that without it, ISPs and telecoms become gatekeepers of the internet rather than pipes for it. They gain the power to shape which services succeed, which content gets seen, and what a user's internet experience actually looks like — based not on what the user chooses but on what commercial arrangements exist between telecoms and content providers.

The 5G slicing argument is more nuanced than a straightforward rollback. The use cases being cited — healthcare monitoring, industrial applications, autonomous vehicles — are ones where differentiated network performance has genuine technical justification. A remote surgical procedure requires different latency guarantees than a social media feed. 

The concern isn't that 5G slicing has no legitimate applications. It's that once exceptions are carved into a net neutrality framework for technical reasons, the boundary between "technical necessity" and "commercial opportunity" is very difficult to maintain.

A global trend worth watching

India's review isn't happening in isolation. The US revoked federal net neutrality rules, leaving enforcement to individual states — some of which have passed their own protections, creating a patchwork. The EU is conducting its own review. Telecoms globally have been pushing for the right to monetize network slicing, and the regulatory frameworks built before 5G are under pressure everywhere.

India's version of this review is significant because India's 2018 net neutrality framework was notably strong — the result of a mass public consultation that generated millions of comments. The TRAI process now underway will determine whether that framework gets updated to accommodate new technology with clear safeguards, or whether the revision opens the door to the kind of commercial differentiation that net neutrality was designed to prevent.

The distinction between those two outcomes is everything. A framework that explicitly permits medically or safety-critical network slicing while explicitly prohibiting commercial fast lanes for content and services is a different thing from a framework that creates flexibility without clear limits. The government's stated intention — "safeguards will prevent discriminatory practices and ensure the internet remains free" — is the right framing. Whether the eventual rules deliver on it is the question worth watching.
